The European Protection of Human Rights - Quo vadis? On (not only) the EU Charter of Fundamental Rights and the so-called Czech Opt-out

The contribution deals with the ambiguous attitude of the Czech Republic to the EU Charter of Fundamental Rights. Although the Czech diplomacy had have no objection during the negociation of the Lisbon Treaty which incorporated the Charter into EU primary law, the requirement to extend the Protocol concerning Poland and the UK also to the Czech Republic came at the moment of the ratification in 2009. Příspěvek se zabývá nejednoznačným postojem České republiky k Chartě základních práv Evropské unie. Ačkoliv česká diplomacie během vyjednávání Lisabonské smlouvy, která zapracovává Chartu do primárního práva evropských států, nepožadovala žádnou výjimku, podmínku pro připojení k Protokolu, který si vyjednalo Polsko a Velká Británie, začalo Česko uplatňovat až při podpisu v roce 2009.

Where is the legal protection of animals heading for?

In the last decades, the society worldwide becomes more sensitive to animal suffering and this new ethical approach has already been deeply reflected by law. In many states, an increasing interest in animal issues mirrors in the civil, constitutional, criminal and administrative law, in order to ensure the animals better living conditions. Now, new voices call for recognizing animal rights as rights similar to basic human rights, to get even stronger position of animals in law. The paper shows that the legal treatment of animals is coming to an intersection, with an open question, to what direction will the future animal protection head for. V posledních desetiletích dochází ve společnosti k postupnému zvyšování citlivosti vůči utrpení zvířat, což má již hluboké odezvy v platném právu. V mnohých státech se rostoucí zájem o ochranu zvířat odráží v právu občanském, ústavním, trestním i správním, s cílem zajistit zvířatům v lidské péči lepší životní podmínky. Nyní se objevují nové hlasy volající po přiznání práv zvířat jako práv obdobných základním lidským právům, aby byla právní pozice zvířat ještě více posílena. Příspěvek ukazuje, že právo se v otázce ochrany zvířat ocitá na jakési křižovatce a otevírá otázku, jakým směrem se bude tento obor nadále vyvíjet.

Inspirational Force of the General Austrian Civil Code in the Proposal of the Civil Code for the Czech Republic

The contribution indicates that the author is one of the key persons participating in the preparation of recodification of the Czech Civil Code. The author pays attention to the development of the proposal of the Code from the preliminaries and laying down the conceptual basis to passing the proposal by the government in May 2011. He points out that the main postulates adopted by the modern codification are ideas which were already expressed in the General Austrian Civil Code, such as respecting a person as a free individual and acceptance of the role of a judge as an authority which both applies and makes law. Z příspěvku je patrné, že autor je jednou z hlavních osob podílejících se na přípravě rekodifikace občanského zákoníku v České republice. Autor se zastavuje u vývoje návrhu zákoníku od počátečních příprav a tvorby koncepčních základů až po schválení návrhu zákona vládou v květnu 2011. Zdůrazňuje, že hlavními postuláty přijatými pro moderní kodifikaci jsou myšlenky, které byly vyjádřeny již v AGBG, a jde o respekt k člověku jako svobodnému individuu a přijetí úlohy soudce jako činitele, který právo nejen uplatňuje, ale i spoluvytváří.

The article analyses the legal regulation of the cathegory of animal species requiring special care under the Act No. 246/1992 Coll., on the protection of animals against cruelty and its development from the cathegory of dangerous animal species and it describes the types of legal instruments that are nowadays applied for its regulation. Příspěvek analyzuje vývoj kategorie nebezpečných druhů zvířat podle zákona č. 246/1992 Sb., na ochranu zvířat proti týrání, do nynější podoby kategorie druhů zvířat vyžadujících zvláštní péči a popisuje jednotlivé typy právních nástrojů, které jsou v současnosti využívány k její regulaci.

The Act on the Police of the Czech Republic empowers policemen to enter certain types of premises of the keeper even without his or her consent if there is a reasonable suspicion of animal abuse. The article deals with the description of relevant legal provisions and gives some remarks of their practical implementation. Zákon o Policii ČR opravňuje policistu vstoupit při podezření na týrání zvířete do vymezených typů objektů chovatele i bez jeho souhlasu. Předmětem příspěvku je rozbor příslušného ustanovení a uvedení poznatků z jeho aplikace.

What Can Tell us the History of Bills of Rights?

In his text, the author focused mainly on historical bills of rights, particularly on English Magna Carta of 1215 and the Bill of Rights of 1689, American Bill of Rights of 1791 and French Declaration of the Rights of Man and the Citizen of 1789. The author paid attention to a remarkable feature of these bills, i.e. the fact that they had not been applied in practice for a long time. Autor se ve svém textu soustředil zejména na historické listiny práv, konkrétně na anglickou Magnu Chartu z roku 1215 a Listinu práv z roku 1689, americkou Listinu práv z roku 1791 a francouzskou deklaraci práv člověka a občana z roku 1789 a všímá si pozoruhodného znaku těchto listin, a to, že se po velmi dlouhou dobu v praxi neaplikovaly.

The metamorphoses in law in the last twenty years are related to the issue of the transformation of the role of the state. In his contribution, the author deals with the role of the state from a more general point of view, i.e. he views the state as an authoritarian insurance company. Se změnami v právu za posledních dvacet let souvisí i otázka proměny role státu. Autor se ve svém příspěvku věnuje roli státu z obecnějšího hlediska, a to pohledu na stát jakožto mocenskou pojišťovnu.
