Administrative penalties and protective measures Summary The thesis deals with the topic of administrative penalties and protective measures in the Czech legal system. The aim is to comprehensively summarize the subject matter and to propose solutions for the shortcomings found. The information on their goal and function, the applicable legislation, the principles that govern them, the shortcomings in their application in practice and other aspects of the issue at hand were obtained mainly by studying and analyzing the legislation, the relevant professional literature as well as the applicable case law of the Constitutional Court as well as the Supreme Administrative Court. The first chapter of the thesis is dedicated to the principles of administrative punishment, focusing on those which, in according to the authors opinion, have the greatest influence on the content, relations and system of the types of administrative punishments and protective measures themselves. The second chapter is devoted to administrative punishments in general, their features, some differences between them and other legal consequences of unlawful conduct, and their other attributes. Správní tresty a ochranná opatření Abstrakt Diplomová práce se zaobírá tématem správních trestů a ochranných opatření v Českém právním řádu. Cílem je komplexně shrnout předmětnou problematiku a navrhnout řešení k nalezeným nedostatkům. Informace o jejich účelu a funkci, platné právní úpravě, zásadách, které je ovládají, nedostatcích při jejich aplikování v praxi a dalších aspektech dané problematiky byly získány především studiem a rozborem právních norem, předmětné odborné literatury a rovněž aplikovatelné judikatury Ústavního soudu a Nejvyššího správního soudu. První kapitola práce je věnována zásadám správního trestání se zaměřením na ty z nich, které mají dle názoru autora největší vliv na obsah, vztahy a systém samotných druhů správních trestů a ochranných opatření. Druhá kapitola se věnuje správním trestům obecně, jejich znakům, některým rozdílům mezi nimi a ostatními právními následky protiprávního jednání a také jejich dalším atributům. The topic of the thesis is assessment of speech as a language skill of secondary school students during Russian language lessons. The theoretical part is dedicated to assessment in the process of learning, its purpose, functions and types. The next part involves assessing as a part of teaching a foreign language, following up with detailed focus on assessment of speech of secondary school students. In practical part, it is analyzed to what extent the assessment of speech during Russian language lessons in secondary schools is being applied, or what types of assessment are represented. The thesis Issues of Penitentiary Treatment of Juvenile Convicts analyses current penitentiary approaches to male juvenile prisoners in the Czech Republic which is the aim of this thesis. The characteristics of juvenile convicts as a specific group of prisoners are discussed in the theoretical part. Juveniles are further described from a criminological perspective in relation to the specifics of committing an illegal activity, from a penological perspective in relation to punitive actions, and from a penitentiary perspective in relation to the execution of the punitive action. The thesis also presents the Prison Service of the Czech Republic as well as the penitentiary treatment of juvenile convicts in Slovakia. The empirical research itself focuses on the analysis and characteristics of the penitentiary treatment of juvenile convicts in Czech prisons which are profiled for juvenile males. The qualitative research using a case study and a structured interview was conducted as a part of the empirical research. V teoretické části je provedena charakteristika mladistvých odsouzených jakožto specifické skupiny vězněných osob. Mladiství jsou dále vystihováni z kriminologického pohledu ve vztahu ke specifikům při páchání protiprávní činnosti, z penologického pohledu ve vztahu k trestnímu opatření, z penitenciárního pohledu ve vztahu k výkonu trestního opatření. V disertační práci je dále představena Vězeňská služba České republiky a penitenciární zacházení s mladistvými odsouzenými na Slovensku. Vlastní empirické šetření se zaměřuje na analýzu a charakteristiku penitenciárního zacházení s mladistvými odsouzenými v českých věznicích, které jsou profilovány pro mladistvé muže. V rámci empirického šetření byl proveden kvalitativní výzkum, v němž byly uplatňovány metody výzkumu kazuistika a strukturovaný rozhovor. Agreement on guilt and punishment and alternative criminal proceedings Abstract This thesis deals with alternative criminal proceedings and agreement on guilt and punishment in the first place. The agreement on guilt an punishment as an institute has no tradition in the Czech legal order and was introduced into Czech law due to influence of common law. The agreement is seen as an alternative solution in comparison to usual criminal procedure which is shortened due to the aforementioned agreement. The crucial role is played by time - in which stage of criminal prosecution the agreement is concluded: if the conclusion of the agreement takes place immediately after the initiation of the criminal prosecution, later on but ahead of bringing an indictment or whether the agreement is entered into during judicial proceedings or later in a court of appeals. The agreement constitues possibility for a defendant and his defence lawyer to avoid criminal trial and bringing of indictment related to it. Proving guilt and collecting evidence are avoided too. All that is possible due to statement of the defendant that he or she commited deed for which the defendant is prosecuted. This thesis is divided into two main chapters. Dohoda o vině a trestu a další alternativní trestní procedury Abstrakt Téma této práce se týká alternativních trestních procedur, přičemž na první místo řadí dohodu o vině a trestu. Jde o institut, který v českém právní řádu nemá žádnou tradici, byl do něj zařazen pod vlivem angloamerického práva a představuje alternativu ke klasickému průběhu trestního řízení, které bude při využití dohody zkráceno, přičemž za klíčovou lze považovat právě dobu sjednání dohody, zda se tak děje po zahájení trestního stíhání nebo později ale ještě před podáním obžaloby či až v rámci soudního stádia řízení, respektive v rámci řízení odvolacího. Dohoda představuje možnost, jak se vyhnout hlavnímu líčení a s tím souvisejícímu dokazování, podání obžaloby a také zdlouhavému opatřování důkazních prostředků, a to prohlášením osoby, proti níž se řízení vede, že spáchala skutek, pro který je stíhána. Práce je rozdělena do dvou kapitol, první z nich se zabývá charakteristikou dohody, jejím teoreticko-právním vymezením a její zákonnou úpravou v České republice. The aim of this work is to find and analyze Czech translations from Judeo-Spanish, thus building on Czech and international research in Translation Studies in the field of minority languages. However, the thesis is the first research of its kind in the Czech environment, and therefore its next goal is to expand the history of Czech translation from Romance languages. The first, theoretical part of the thesis describes the socio-historical context of the source and target languages and outlines their mutual relationship, or rather "non-relationship" in the course of history. It also defines the terminological framework used and deals in detail with research in the field of the history of translation with an emphasis on "non-book" translations, the relationship of Translation Studies to minority languages and ethics in translation. Methodologically, it relies on Czech and foreign translation theory from the second half of the 20th century to the latest publications. The second, practical part of the thesis presents and analyzes the found sources, relying extensively on paratexts and, where necessary for the understanding of the sources, goes beyond the terminology of Translation Studies towards Jewish Studies. The corpus of discovered sources includes inscriptions on synagogue textiles, oral poetry,... Tato práce si klade za cíl najít a analyzovat české překlady z judeošpanělštiny, a navázat tak na české i mezinárodní bádání translatologie v oblasti minoritních jazyků. Práce je prvním výzkumem svého druhu v českém prostředí, a proto je jejím dalším cílem rozšířit dějiny českého překladu z románských jazyků. První, teoretická část práce popisuje společensko-historický kontext výchozího i cílového jazyka a nastiňuje jejich vzájemný vztah či spíše "nevztah" v minulosti i v současnosti. Vymezuje také užívaný terminologický rámec a detailně se zabývá výzkumem v oblasti dějin překladu s důrazem na "neknižní" překlady, vztahem translatologie k minoritním jazykům a také etikou v překladu. Metodologicky se opírá o českou i zahraniční teorii překladu od druhé poloviny 20. století až po publikace vydané v posledním desetiletí. Druhá, praktická část disertace představuje a analyzuje nalezené prameny, přičemž se rozsáhle opírá o paratexty a tam, kde je to nutné pro pochopení pramenů, přesahuje terminologii translatologie směrem k judaistice. The thesis deals with the reaction of the residents of municipalities threatened with demolition in connection with the threat model presented by Dennis Smith. Two municipalities were selected for research - Horní Jiřetín and Nové Heřminovy. In Horní Jiřetín, there is discussion of the demolition of the municipality in connection with the expansion of brown coal mining and, above all, the progress of mining at the quarry of the Czechoslovak Army. It is planned to build a dam in Nové Heřminy, which should prevent floods in the region in the future and at the same time become a water reservoir for the dry season. The first part of the thesis is devoted to the threat model presented in 2018 by Dennis Smith in his book Civilized Rebels: An Inside Story of the West's Retreat from Global Power. In this part of the thesis, this model is described and put into the context of sociological theories of conflict. The second part of the thesis is devoted to the analysis of qualitative research, which was conducted in both municipalities using interviews with their residents. As part of the analysis, the residents' reactions were described in terms of strategies for coping with the situation and fears for the future. Disertační práce se zabývá reakcí obyvatel obcí, jimž hrozí demolice, v souvislosti s modelem ohrožení prezentovaného Dennisem Smithem. K výzkumu byly vybrány dvě obce - Horní Jiřetín a Nové Heřminovy. V Horním Jiřetíně se o demolice obce hovoří v souvislosti s rozšiřováním těžby hnědého uhlí a především postupováním těžby na lomu Československé armády. V Nových Heřminovech je plánováno postavit přehradu, která by měla do budoucna zabránit potopám v regionu a zároveň se stala zásobníkem vody pro období sucha. První část práce se věnuje modelu ohrožení, který představil v roce 2018 Dennis Smith ve své knize Civilized Rebels: An Inside Story of the West's Retreat from Global Power. V této části práce je tento model popsán a uveden do kontextu sociologických teorií konfliktu. Druhá část práce se věnuje analýze kvalitativního výzkumu, který byl proveden v obou obcích pomocí rozhovorů s jejich obyvateli. V rámci analýzy byly reakce obyvatel popsány z hlediska strategií vyrovnávání se se situací a obav do budoucna. V každé obci jsou pak tyto reakce rozděleny do skupin. Tyto skupiny jsou nakonec ve třetí části nahlíženy a zařazovány z pohledu modelu ohrožení Dennise Smithe. Role of gold in central banking Abstract The first chapter is devoted to the characteristics of central banks as institutions that have a monopoly on the issue of cash money, conduct monetary policy and regulate the banking system. The first central banks emerged in the 17th century. However, they differed from the contemporary central banks. Their primary task was to provide financial resources to the sovereign. They gradually gained more power over time and became the central banks that exist today. Contemporary central banks usually have powers such as issuing cash money, conducting monetary policy, regulation and supervision of the banking sector. Central banks compile their balance sheets, which are statements of the amount and structure of assets and liabilities. Gold is among the items that appear on central bank balance sheets. The second chapter is important for understanding how the gold standard function. It explains concepts such as the pure standard and the modified gold standard, which covers the gold bullion standard, the gold reserve standard and the gold exchange standard. The third chapter describes the evolution of the gold standard since the 1930s when monetary blocks, consisting of states with similiar views on the continuation of the gold standard, were formed. Úloha zlata v centrálním bankovnictví Abstrakt První kapitola se věnuje charakteristice centrálních bank jako institucí, které mají emisní monopol na hotovostní peníze, provádějí měnovou politiku a regulují bankovní systém. První centrální banky vznikaly v 17. století. Od nynějších centrálních bank se však odlišovaly. Jejich primárním úkolem bylo poskytovat finanční prostředky panovníkovi. Postupně získávaly více pravomocí a staly se z nich centrální banky, které existují nyní. Novodobé centrální banky mají většinou pravomoci jako je emise hotovostních peněz, provádění měnové politiky a regulace spojená s dohledem nad bankovním sektorem. Centrální banky sestavují své bilance, které jsou výkazem o výši a struktuře aktiv a pasiv. V rozvahách centrálních bank se mimo jiné objevuje i zlato. Druhá kapitola je důležitá pro pochopení fungování zlatého standardu. (in English) The presented dissertation focuses on investigating the relationship between social housing and the quality of life of its users. The aim is to determine whether social housing programs provide residences that enable users to live the life they aspire to. The study draws inspiration from the expectations concept proposed in 2020, which captures the principles of the philosophical and economic capability approach. Quality of life is assessed by potentialities, defined as the lifestyles achieved by users. This study also theoretically anchors the phenomenon of homelessness and delves into social housing's segment, the role of local self-government, and the strategies for implementing social housing systems. A deductive qualitative analysis serves as the research methodology, with findings derived from 32 semi-structured interviews with program participants and housing support social workers. The study uncovers the social reality of local social housing users and their pursuit of a valuable life. The research confirms the enhancement of so-called housing freedoms among program users and describes the potentialities achieved through access to standard housing. It identifies conversion factors that either enhance or jeopardize housing users' quality of life. Analýza námětů na experimentální činnost v učebnicích chemie pro ZŠ

The aim of the thesis is to analyze experimental activities in chemistry textbooks for primary schools in the Czech Republic. The types of activities and their placement in the phases of teaching, cognitive demand are examined. The analysis includes the most used textbooks of chemistry - textbooks by Fortuna: Základy chemie 1, 2 and Základy praktické chemie 1, 2. Textbooks by Nová škola, Fraus and Taktik for 8th and 9th grade. All textbooks contain suggestions for practical activities, most of them are in the ZCH, FR and NŠ textbooks. Different types of activities are identified in the chemistry textbooks, such as independent student activity, observation of teacher demonstration, laboratory work, watching videos, pictures and solving problems. Independent student activity and observation of teacher demonstration are the most common. FR and T textbooks also offer interactivity through videos. Practical topics focus mainly on the exposure phase of the lesson. In terms of the development of cognitive operations, the tasks in the chemistry textbooks focus on lower-level operations such as memorization, comprehension, and application. Higher operations, especially the development of making, was mainly in the textbooks for grade 8. The textbooks published by NŠ had a balanced representation for both grades. Cílem diplomové práce je analýza experimentálních aktivit v učebnicích chemie pro základní školy. Jsou zkoumány typy aktivit a jejich zařazení do fází výuky, kognitivní náročnost. Analýza zahrnuje nejvíce používané učebnice chemie - učebnice nakladatelství Fortuna: Základy chemie 1, 2 a Základy praktické chemie 1, 2. Dále učebnice nakladatelství Nové školy, Fraus a Taktik pro 8. a 9. ročník. Všechny učebnice obsahují náměty na praktickou činnost, nejvíce jich je v učebnicích ZCH, FR a NŠ. V učebnicích chemie jsou identifikovány různé typy aktivit, jako samostatná činnost žáka, pozorování demonstrace učitele, laboratorní práce, sledování videa, obrázků a řešení úkolů. Nejčastěji se vyskytuje samostatná činnost žáka a pozorování demonstrace učitele. Učebnice FR a T nabízejí také interaktivitu prostřednictvím videí. Praktické náměty se zaměřují především na expoziční fázi výuky. Co se týče rozvoje kognitivních operací, úlohy v učebnicích chemie se zaměřují na nižší operace, jako je zapamatování, porozumění a aplikace. Vyšší operace, zejména rozvoj tvorby, byl především v učebnicích pro 8. ročník. Učebnice nakladatelství NŠ měly vyrovnané zastoupení pro oba ročníky.

Formal and Linguistic Aspects of Judicial Decisions Abstract The central theme of the thesis is a written form of justification of judicial decisions, which is a crucial element in preventing arbitrariness in judicial decision-making. The aim of the thesis is to examine current form of civil judicial decisions of district courts. In order to do so, the thesis starts by doctrinally defining types of macrostructure and internal logic of judicial decisions, bound and free decision-making, and especially historical and ideological background of the Anglo-American, French and German judicial styles, which also includes the Czech judicial style. The second part describes sources of legal regulation for the reasoning of a civil judgment at the constitutional, statutory, and sub-statutory levels. From sources of law with contribution of case law and expert literature emerges analytical-descriptive section presenting structure of the present reasoning in Czech civil judgments of courts of first instance. In the next part, the thesis proceeds towards achieving its goal - it subjects 150 judgments to empirical research inspired by content analysis, thereby revealing actual compliance with the requirements placed on judges in providing written justifications for judgments. Formální a jazykové aspekty soudních rozhodnutí Abstrakt Ústředním tématem práce je písemná podoba odůvodnění soudního rozhodnutí, které je důležitým prvkem v zamezení libovůle v soudním rozhodování. Cílem práce je analyzovat současnou podobu civilních soudních rozhodnutí okresních soudů. K tomu práce na úvod doktrinálně vymezuje druhy makrostruktury a vnitřní logiky soudních odůvodnění, vázanou a volnou aplikaci práva a především historické a ideologické pozadí angloamerického, francouzského a německého soudního stylu, jehož součástí je i styl český. Druhá část popisuje prameny právní úpravy odůvodnění civilního rozsudku na ústavní, zákonné i podzákonné úrovni. Z těchto pramenů následně za přispění judikatury a odborné literatury vyvěrá analyticko-popisná část představující podobu současného odůvodnění českého civilního rozsudku soudu prvního stupně. V další části přistupuje práce k dosažení svého cíle - podrobuje 150 rozsudků empirickému výzkumu inspirovanému obsahovou analýzou, čímž odhaluje skutečné dodržování požadavků kladených na soudce při písemném odůvodnění rozsudku. Tento výzkum navíc umožňuje práci odkrýt další, ať už pozitivní, či negativní jevy vyskytující se v odůvodněních, které dosud nebyly zmíněny v odborné literatuře.
