Disability and Invalidity Pension Abstract The theme of disability is a sensitive topic in society, as it represents an undesirable social event affecting an individual's work capacity and consequently having an adverse impact on their financial security. The invalidity pension serves as a benefit designed to compensate for this negative consequence to some extent. This work deals with the issue of disability, particularly the invalidity pension, organized into 9 chapters. The introductory chapter provides a brief historical overview of disability, followed by a discussion of the historical legal conditions for granting an invalidity pension in the Czech Republic. It then delves into international interventions through treaties and the membership of international organizations, of which the Czech Republic is a signatory. This chapter mentions international organizations, including the most significant international treaties addressing this issue, to which the Czech Republic is bound. Given that the Czech Republic is a member of the European Union, and its the legal regulations significantly influence the national legal framework of the Czech Republic, this aspect is incorporated into the work. Invalidita a invalidní důchod Abstrakt Tématika invalidity je ožehavým tématem ve společnosti, neboť se jedná o nežádoucí sociální událost v bytí jedince mající imanentní vliv na jeho pracovní schopnost a s tím pochopitelně související nepříznivý dopad na materiální zabezpečení. Invalidní důchod představuje dávku, jež má onen negativní následek do jisté míry vykompenzovat. Daná práce se tedy zaobírá problematikou invalidity a zejména invalidního důchodu, přičemž práce je členěna do 9 kapitol. Úvodní kapitola popisuje stručný historický nástin invalidity, načež navazuje na historickou právní úpravu podmínek pro přiznání invalidního důchodu na území České republiky. Následuje intervence mezinárodních smluv a členství mezinárodních organizací, jejichž signatářem je Česká republika. V této kapitole jsou zmiňovány mezinárodní organizace včetně nejstěžejnějších mezinárodních smluv zaobírající se danou problematikou, jimiž je Česká republika vázána. Vzhledem k tomu, že Česká republika je členem Evropské unie a její právní úprava význačným způsobem ovlivňuje vnitrostátní právní úpravu České republiky, nemohla být pochopitelně z tohoto důvodu opomíjena a je rovněž zakomponována do této práce. Proportionality of the electoral system for the Chamber of Deputies Abstract Proportional system allocates to a party a percentage of seats equal to the percentage of the votes received in the election. Because of the indivisibility of seats and in the interest of the functionality of the elected body, full proportionality can never be achieved. However, its level can be significantly influenced by manipulating the variables of the electoral system. Because of the contradiction with the principles of proportional representation and the principle of equality required by the Constitution the Constitutional Court in its decision Pl. ÚS 44/2017 just eight months before the elections, it repealed important provisions of the Act on Elections to the Parliament of the Czech Republic, in particular the electoral formula and the additive closing clause for coalitions. Due to the upcoming elections to the Chamber of Deputies, Parliament was forced to quickly adopt a compromising amendment. The main goal of this thesis is to determine whether this amendment, adopted as Act No. 189/2021 Coll., which replaced the existing D'Hondt method with a non-traditional Imperiali quota and introduced a second, nationwide, scrutiny to redistribute the remaining votes, fulfilled the requirements of the Constitutional Court and... Poměrnost volebního systému do Poslanecké sněmovny Abstrakt Proporcionální je systém, který straně přidělí procento mandátů odpovídající procentu získaných hlasů ve volbách. Kvůli nedělitelnosti mandátů a v zájmu funkceschopnosti voleného sboru sice nelze úplné proporcionality nikdy dosáhnout, její míru lze však významně ovlivnit manipulací s proměnnými volebního systému. Právě pro rozpor s ústavou požadovanými zásadami poměrného zastoupení a principem rovnosti zrušil Ústavního soud v rozhodnutí sp. zn. Pl. ÚS 44/2017 pouhých osm měsíců před volbami důležitá ustanovení zákona o volbách do Parlamentu ČR, zejména volební formuli a aditivní uzavírací klauzuli pro koalice. Kvůli blížícím se volbám do Poslanecké sněmovny byl Parlament nucen urychleně přijmout kompromisní novelu. Hlavním cílem práce je zjistit, zda tato novela přijatá jako zákon č. 189/2021 Sb., jež dosavadní D'Hondtův dělitel nahradila netradiční Imperialiho kvótou a k přerozdělení zbylých hlasů zavedla druhé, celorepublikové, skrutinium, naplnila požadavky Ústavního soudu a zvýšila proporcionalitu volebního systému do Poslanecké sněmovny, a to z celostátního pohledu. Cardiovascular disease, including ischemic heart disease, its acute form of myocardial infarction and subsequent heart failure, is still the most common cause of death in the world. For decades, scientists have been aiming to find clinically usable cardioprotective interventions that effectively prevented this disease or reduced the consequences of this disease and improved the quality of life of patients. It is known that a healthy lifestyle, which includes long-term hardening, contributes to heart protection. The beneficial effects of hardening on personality have been known for two hundred years, but no one before us has investigated the effect of a cold environment on the magnitude of ischemia-reperfusion (I/R) damage 10 years ago, we introduced a model of mild cold exposure (8 ± 1 řC) (MCE) which was protective on the size of the myocardial infarction and at the same time no negative side effects such as hypertension and myocardial hypertrophy were demonstrated. Our aim was to investigate the mechanism of cardioprotection induced by MCE. We asked the following questions: What is the metabolic profile of rats exposed to MCE? What is the effect of MCE on the magnitude of I/R damage in the short and long term? When does brown adipose tissue mature during MCE? Which signalling pathways are... Kardiovaskulární onemocnění, mezi které patří ischemická choroba srdeční, její akutní forma infarkt myokardu, a následné srdeční selhání, se stále řadí mezi nejčastější příčinu úmrtí na světě. Již desítky let si vědci kladou za cíl najít klinicky využitelné kardioprotektivní intervence, které by účinně předcházely tomuto onemocnění, a tak zmenšovaly následky tohoto onemocnění a zlepšily kvalitu života pacientů. Je známo, že k ochraně srdce významně přispívá zdravý životní styl, jehož součástí je i dlouhodobé otužování. Benefiční účinky otužování na posílení organismu jsou známy již dvě sta let, zatím však nikdo před námi nezkoumal vliv chladného prostředí na velikost ischemicko-reperfúzního poškození (I/R). Před 10 lety jsme zavedli model mírné chladové expozice (8 ± 1 řC) (MCE), který byl protektivní na velikost infarktu myokardu a zároveň se neprokázaly negativní vedlejší účinky jako je hypertenze a hypertrofie myokardu. Naším cílem tedy bylo zkoumání mechanismu kardioprotekce vyvolané MCE. Položili jsme si následující otázky. Jaký je metabolický profil potkanů vystavených MCE? Introduction: Thrombophilic conditions may be accompanied by increased thrombin generation (TG), especially during pregnancy when the increase in thrombin generation results from a series of changes in the haemostatic system. During administration of anticoagulant treatment, it is desirable to reduce the increase in thrombin generation. Aims of the study: The first aim of our study was to compare TG in individuals with a proven factor V Leiden mutation and individuals with elevated levels of factor VIII. Another aim was to compare patients with VTE and also with or without proven FV Leiden mutation that are taking different anticoagulation treatments. The final aim was to assess thrombin generation in pregnant women and their response to LMWH administration during severe thrombophilic conditions. Group of patients and methods: There were included 170 healthy blood donors in the control group, the congenital and acquired thrombophilia group included 44 individuals with FV Leiden mutation and 38 individuals with factor VIII level >150 % without other proven thrombophilia. 347 subjects with VTE taking direct coagulation inhibitors were included in the anticoagulation group. Sixty women with a prophylactic dose of LMWH were included in the group of pregnant women. Kit Technothrombin® TGA RC Low and RC... Úvod: Trombofilní stavy mohou být provázeny zvýšenou generací trombinu, zvláště pak v těhotenství, kdy nárůst generace trombinu vyplývá z řady změn v hemostatickém systému. Při podávání antikoagulační léčby je žádoucí nárůst generace trombinu snížit. Cíle studie: Jedním z cílů naší studie bylo porovnat generaci trombinu u jedinců s prokázanou mutací faktoru V Leiden a jedinců se zvýšenou hladinou faktoru VIII. Dalším úkolem bylo porovnat pacienty s VTE s prokázanou mutací faktoru V Leiden (nebo bez ní) a užívající rozdílnou antikoagulační léčbu. Posledním cílem bylo posoudit generaci trombinu u těhotných žen a jejich odpovědi na podávání LMWH při závažném trombofilním stavu. Soubor pacientů a metody: Do kontrolní skupiny bylo zařazeno 170 zdravých dárců krve, do skupiny vrozené a získané trombofilie bylo zahrnuto 44 jedinců s mutací faktoru V Leiden a 38 jedinců s hladinou faktoru VIII >150 % bez další prokázané trombofilie. Do skupiny s antikoagulační léčbou bylo zařazeno 347 jedinců s VTE užívajících přímé inhibitory koagulace. Do skupiny těhotných žen bylo zařazeno 60 žen s profylaktickou dávkou LMWH. Think this way in Christ Jesus. Exegesis Phil 2:5.6-11 The licentiate thesis focuses on the hymn in Epistle to the Philippians and its exegesis. The thesis analyses this epistle, characterises the hymn and also examines its literary form, origin, authorship, and both biblical and non-biblical background. Without theological pre- understanding of the text, the thesis aims to provide the most accurate and correct exegesis of the hymn. Its exegesis is subsequently used to assess three widespread theological theories (theory of Kenosis, The Imitation of Christ, and theory of Binitarian Monotheism) which according to their respective authors originate from the hymn. Based on the parenthetic context of the hymn, the thesis suggests that this text does not discuss the ontological description of Christ's existence, but rather focuses on Jesus' humbling and giving of oneself attitude that is inspirational for a Christian life and Philippians' mission, but might also play an important role in the contemporary approach to pastoral work. Licenciátní práce se zabývá hymnem v Listu Filipanům a jeho exegezí. Analyzuje daný list, charakterizuje hymnus v jeho rámci, zabývá se rovněž jeho literární formou, původem, autorstvím a (mimo)biblickým pozadím. Bez teologických předporozumění usiluje o co nejpřesnější a nejkorektnější exegezi zkoumaného hymnu. Na jejím základě pak hodnotí tři rozšířené teologické teorie, které podle jejich autorů vycházejí z daného hymnu: teorie kenóze, problém imitatio Christi a teorie binitárního monoteismu. Vzhledem k parenetickému kontextu dochází k závěru, že tento text nepojednává o ontologickém popisu Kristova bytí, ale zabývá se Ježíšovým postojem ponížení se a vydání sebe sama, který je inspirativní pro křesťanský život i misii Filipanů a důležitou roli může hrát i v dnešním pojetí pastorace.

The central theme of the thesis is activating teaching methods, of which eleven were selected and used for its research. Specifically, these were the following ones: brainstorming, guided discussion, snowball method, inquiry-based learning, I.N.S.E.R.T. method, work with text, concept map, mind map, critical thinking method, rounds and CLIL (Content and Language Integrated Learning). These selected activating teaching methods were compared according to how the students evaluated them through attitude questionnaires, which is determined as the main aim of the work. Attitude questionnaires were created from the IMI (Intrinsic Motivation Inventory) tool. In the attitude questionnaire, the students evaluated the individual teaching methods in scales of interest/pleasure, perceived competence, effort/importance, pressure/tension and value/usefulness. In the scale of interest/pleasure, the snowball method was the best evaluated by the pupils, in the perspective of perceived competence also the snowball method, in the effort/importance scale the CLIL method, in the scale of pressure/tension inquiry-based learning and in the scale of value/usefulness again the snowball method. For further evaluation of the results, an index of subjective evaluation of teaching methods was created. It showed that the best... Ústředním tématem rigorózní práce jsou aktivizující výukové metody, z kterých se do výzkumu diplomové práce vybralo a použilo jedenáct a to konkrétně: brainstorming, řízená diskuze, metoda sněhové koule, badatelsky orientovaná výuka, metoda I.N.S.E.R.T., práce s textem, pojmová mapa, myšlenková mapa, metoda kritického myšlení, kolečka a CLIL. Tyto vybrané aktivizující výukové metody se mezi sebou porovnávaly podle toho, jak je žáci hodnotili prostřednictvím postojových dotazníků, což je stanoveno jako hlavní cíl práce. Postojové dotazníky byly vytvořeny z nástroje IMI (Inventáře vnitřní motivace). V každém postojovém dotazníku žáci hodnotili jednotlivé výukové metody ve škálách zájem/potěšení, vnímaná kompetence, úsilí/důležitost, tlak/tenze a hodnota/užitečnost. Ve škále zájem/potěšení byla žáky nejlépe vyhodnocena metoda sněhové koule, ve škále vnímaná kompetence také metoda sněhové koule, ve škále úsilí/důležitost metoda CLIL, ve škále tlak/tenze badatelsky orientovaná výuka a ve škále hodnota/užitečnost opět metoda sněhové koule. Pro další zhodnocení výsledků byl pro tuto práci vytvořen index subjektivního hodnocení výukových metod, který ukázal, že nejlépe ze všech metod byla hodnocena žáky badatelsky orientovaná výuka a nejhůře metoda kritického myšlení. This dissertation thesis goes into the depths of philosophical reflection on the nature of human existence and its relationship to life and death, especially for individuals who have gone through extreme life situations. The thesis explores attitudes towards free will, life and death in people who have found themselves on the brink of life, whether due to addiction, illness or other life-threatening situations. The aim is not only to analyse changes in these individuals' attitudes towards life and death, but also to explore the intellectual and philosophical development that may be prompted by this existential limit. Regardless of the cause of this confrontation with the limit of life and death, we seek to uncover how this experience affects the deeper dimensions of human existence. The work is based on the conviction that illness, although challenging on the physical plane, has an extraordinary effect on the spiritual sphere. It also highlights the impact of illness on the physical and spiritual aspects of the human being and seeks to show this by examining the works of great philosophers whose ideas have shaped the world. We will support this claim by analysing the works of important philosophers whose ideas have shaped our understanding of human existence. From Aristotle to Descartes, Nietzsche... Tato disertační práce vstupuje do hlubin filozofické reflexe nad podstatou lidské existence a jejím vztahem k životu a smrti, a to zejména u jednotlivců, kteří prošli extrémními životními situacemi. Zkoumá postoj ke svobodné vůli, životu a smrti u lidí, kteří se ocitli na pokraji života ať už kvůli závislosti a nemoci, nebo jiným život ohrožujícím situacím. Cílem je nejen analyzovat změny v postojích těchto jednotlivců k životu a smrti, ale též zkoumat duševní a filozofický rozvoj, který může být podněcován tímto existenčním limitem. Bez ohledu na příčinu této konfrontace s hranicí života a smrti se snažíme odhalit, jak tato zkušenost ovlivňuje hlubší rozměry lidského bytí. Práce vychází z přesvědčení, že nemoc, ačkoli představuje výzvu pro fyzickou rovinu, působí mimořádně i na duševní sféru. Rovněž poukazuje na dopad nemoci na fyzickou a duchovní stránku člověka a snaží se to ukázat na základě zkoumání děl významných filozofů, jejichž myšlenky formovaly svět. Toto tvrzení podložíme analýzou děl významných filozofů, kteří svými myšlenkami formovali naše chápání lidské existence. This Ph.D. thesis aims to clarify the notion of will of Arthur Schopenhauer in a historical context. The understanding of will in Schopenhauer's predecessors - Descartes, Leibniz, Kant and Hegel - will also be covered. The paper will try to discover what impact their notion of will had on Schopenhauer's philosophy, which is the topic of the second, most important part of the thesis. It will present Schopenhauer's understanding of the world as will and idea. According to Schopenhauer, everything in the world is subordinate to causal laws, which the thesis also presents. There are even more topics to be covered - the partition of the world to subject and objects, which exist only for the subject, examples of manifestation of the will in nature and different branches of science, the impossibility of freedom and so on. Our attention will also be focused on what impact Schopenhauer's notion of will had on his aethetics and ethics. The last part deals with the voluntarism of Friedrich Nietzsche, who transforms Schopenhauer's pessimistic notion of a cruel will to life to an optimistic will to power. In relation to this, several topics will be covered - ressentiment as a consequence of the massive spread of slave morality, the cruitique of Christianity and Nietzsche's expectation of the overman's arrival. Tato disertační práce si klade za cíl objasnit Schopenhauerovo pojetí vůle v historickém kontextu. Bude představeno chápání vůle u Schopenhauerových předchůdců - Descarta, Leibnize, Kanta a Hegela - a poukázáno na způsob, jakým ovlivnilo samotnou Schopenhauerovu filosofii. Na tu se soustřeďuje druhá, stěžejní část práce. Nejprve bude představeno Schopenhauerovo chápání světa jakožto vůle na jedné straně a představy na straně druhé. Pozornost bude věnována typům kauzality, kterou je možno podle Schopenhauera nalézt ve všech dějích, a tedy neexistuje svoboda, vše se děje nutně. Dále se práce věnuje rozdělení všeho jsoucího na subjekt a objekt, přičemž objekty existují pouze pro subjekt. V další části se budeme věnovat projevům vůle v přírodě a různých oblastech vědy. Následuje pojednání o odrazu Schopenhauerova pojetí vůle v jeho estetice a etice. Poslední kapitola nastiňuje přetvoření Schopenhauerova voluntarismu v díle Nietzschově, který od pesimistické představy kruté vůle k životu, způsobující utrpení a věčné chtění, přechází k optimistickému pojmu vůle k moci, která jedince vede k neustálému růstu, zdokonalování, překonávání ostatních. Legislation on the protection of farm animals Abstract The thesis deals with the legal regulation of the protection of livestock with an emphasis on their breeding, transport, and slaughter. This thesis aims to find out what legal protection is provided to farm animals by the current legislation, what living conditions farm animals are entitled to under the law and whether this protection is sufficient. The thesis is divided into five chapters, the most detailed of which is the second one, which analyses the legal regulation of livestock farming, including the special rules that apply to pregnant females and their young, livestock production, castration and sterilisation. The thesis also examines the legal regulation of the transport of livestock, both between EU Member States and to third countries outside the EU. Last but not least, the thesis examines the legislation laying down rules for the slaughter and killing of livestock. A separate chapter is also devoted to the institutions responsible for enforcing legislation on the protection of farm animals. The thesis reaches three main conclusions. Animal protection legislation is found in too many different legal texts, which makes the legal protection of animals highly fragmented and incomplete. Cílem této práce je zjistit, jakou ochranu hospodářským zvířatům poskytuje platná právní úprava, na jaké životní podmínky mají hospodářská zvířata dle práva nárok a zdali je tato ochrana dostačující. Práce je rozdělena do pěti kapitol, z nichž nejpodrobnější je druhá z nich, která analyzuje právní úpravu chovu hospodářských zvířat včetně speciálních pravidel, jež platí pro březí samice a jejich mláďata, živočišnou výrobu, kastraci a sterilizaci. Dále se práce věnuje právní úpravě přepravy hospodářských zvířat, a to jak přepravě, která probíhá mezi jednotlivými členskými státy EU, tak přepravě zvířat do třetích států mimo Unii. V neposlední řadě se práce zabývá legislativou stanovující pravidla pro porážení a usmrcování hospodářských zvířat. Samostatná kapitola je věnována také institucím, jež mají prosazování právních norem v oblasti ochrany hospodářských zvířat na starosti. Práce dospěla ke třem hlavním závěrům. Právní úprava ochrany hospodářských zvířat se nachází v příliš velkém množství právních předpisů různé právní síly, což právní ochranu hospodářských zvířat činí značně roztříštěnou a nekomplexní. Legal position of the forced heir Abstract This rigorous thesis discusses the legal position of the forced heir. This is one of the major topics in the law of succession and it affects wider public. Forced heirs are guaranteed to receive special protection consisting mainly of property inheritance benefits, even against the will of a testator. Defining the legal position of the forced heir represents a certain compromise between the principles of mandatory family protection and the autonomy of the testator's will. The goal of this thesis is to provide a comprehensive overview of the position of the forced heir, focusing on certain disputable topics and practical applications. The thesis aims to link legislation with practical examples and to describe changes that are being introduced to the legal status of forced heirs by the practise of courts and by professional literature. Jedná se o stěžejní oblast dědického práva, která se dotýká široké veřejnosti. Nepominutelným dědicům je i proti vůli zůstavitele garantována zvláštní ochrana, která spočívá zejména v právu na majetkový prospěch z pozůstalosti. Vymezení právního postavení nepominutelného dědice představuje určitý kompromis mezi zásadou zachování hodnot a zásadou autonomie vůle zůstavitele.
