CASTLE LIBRARY OF OTTO JR. OF NOSTITZ IN JAWOR The library of Otto Jr. of Nostitz was founded in the beginning of the 1650's in the Lower Silesian castle Jawor. It consists approximately of 5 000 volumes and its structure as well as its history makes it unique and elevates the Jawor library among the most interesting book collections of early modern Europe. Shortly after death of its founder, the library was bought by Otto's brother Johann Hartwig of Nostitz and moved to the newly built palace in Malá Strana in Prague where it laid the foundations of the new family library of the house of Nostitz. The library is placed in two rooms on the second floor till today. The thesis tries to introduce the personality of the founder of the Jawor library Otto Jr. of Nostitz, his tastes in the book purchase as well as the topical structure of his book collection and its future fates. Notwithstanding, the main point of the doctor thesis is to present the issues of the thorough provenance research of the oldest part of the library. The terminus ante quem for the year of edition of the books relevant for the provenance research marks out the death of Otto Jr. in the year 1665. JAVORSKÁ ZÁMECKÁ KNIHOVNA OTTY MLADŠÍHO Z NOSTIC Někdejší zámecká knihovna z dolnoslezského Javoru představuje jedinečný barokní knihovní soubor, jenž vznikl krátce po polovině 17. století sběratelskou činností Otty mladšího z Nostic, významného raně novověkého bibliofila. Krátce po jeho smrti byl celý knihovní fond čítající bezmála 5 000 svazků společně s neknižními sbírkami zakoupen jeho bratrem Janem Hartvíkem, hrabětem z Nostic a převezen do Prahy. V nově vystavěném paláci na malostranském Maltézském náměstí byla Ottova knižní sbírka položena za základ budoucí Majorátní knihovně hrabat z Nostic a Rienecka, v jejímž fondu se javorská zámecká knihovna dochovala téměř v úplnosti až do dnešních dnů. Tato disertační práce si klade za cíl představit původce javorské knihovny Ottu mladšího z Nostic, jeho knihovnu, její obsahové složení i osudy po Ottově smrti. Hlavní složkou doktorandské práce jsou však výsledky zevrubného provenienčního průzkumu nejstarší části knihovního fondu. Nostická knihovna dosud disponuje pouze zastaralým katalogem z 19. století, který nepokrývá fond v úplnosti (adligáty v přívazcích) a namnoze reformuluje znění knižních titulů. The presented dissertation deals with the portrayal of the Bohemian homeland ("Heimat") in the prosaic work by the Austrian writer Gertrud Fussenegger (1912-2009), born in Pilsen. The picture of homeland is analysed using Homi K. Bhabha's theoretical notions "hybridity" and "third space" (without their postcolonial background). The goal of the dissertation is to find out how the cultural heterogenity of Bohemia is reflected in Fussenegger's works. Another goal is to position Gertrud Fussenegger within the German literature in the Bohemian lands. The results of the analysed works show that in some aspects the texts go beyond binary, nationality-based models towards a more complex and heterogenic form of depicting the coexistence of Czechs and Germans (mainly at the level of depicting space and personal constellations). In other cases (especially when the texts present historical events or at the level of narrative space) there are noticeable antithetic schemes in the texts which portray the Czech and German culture as separate, opposing entities. Předložená disertační práce se zabývá ztvárněním české vlasti ("Heimat") v prozaickém díle rakouské spisovatelky a plzeňské rodačky Gertrud Fussenegger (1912-2009). Obraz vlasti je zkoumán pomocí teoretických pojmů "hybridita" a "třetí prostor" Homiho K. Bhabhy (bez zohlednění postkoloniálního pozadí těchto termínů). Cílem práce je zjistit, jak se v díle Fussenegger odráží kulturní rozmanitost českého prostředí. Kromě analýzy literárního obrazu vlasti se práce též zaměřuje na postavení Gertrud Fussenegger v rámci německy psané literatury v českých zemích. Výsledky analýzy zkoumaných děl ukazují, že texty v některých aspektech překračují binární, národnostně podmíněné modely směrem ke komplexnějším, heterogennějším formám ztvárnění česko-německého soužití (zejména na úrovni ztvárnění prostoru a personálních konstelací). V jiných případech (zvláště při zobrazování historických událostí a v rovině vyprávění) jsou v textech patrná antitetická schémata, která českou a německou kulturu staví proti sobě.

The present thesis is concerned with the issues of phraseology against the background of lexicographical processing with the use of corpus based research. Using a comprehensive set of idiomatic expressions containing the names of animals, discrepancies and particularities of contemporary phraseographical descriptions are studied. The idiomatic expressions are subjected to the analyses within the German Corpus DeReKo and their Czech equivalents in the Czech Corpus ČNK. This is followed by critical evaluation of the existing lexicographical work in the selected dictionaries. The thesis aims to give a new insight into the issues of idiomatic expressions processing in the bilingual dictionary under the influence of new data gained from corpora based studies. Předkládaná disertační práce se zabývá problematikou frazeologie na pozadí jejího lexikografického zpracování za využití korpusových rešerší. Na uceleném oddílu frazémů obsahujících názvy zvířat jsou studována a rozporována specifika dosavadního frazeografického popisu. Frazémy jsou podrobovány analýzám v německém korpusu DeReKo a jejich české ekvivalenty v českém korpusu ČNK. Následuje kritické vyhodnocení dosavadní lexikografické práce na vybraných slovnících. Práce se snaží přinést nový náhled na problematiku zpracování frazémů v překladovém slovníku pod vlivem nových dat, která přinášejí korpusy.

Procedural aspects of mediation in EC law Eva Rivera, 2011 1 Abstract The objective of this dissertation is the determination of the significance of procedural aspects of mediation and the answer to the question to what extent it has been considered within European Union law. The research is based on the assumption that the acknowledgment of a procedural relevance of mediation is crucial for its overall effectiveness. Mediation is besides its feature as a communication technique becoming ever more important as a dispute resolution procedure for civil and commercial conflicts in Europe. In this context the role of mediation within and in relation to other procedures for the resolution of disputes has to be considered. While on one hand the terminology and the differences between mediation and other forms of Alternative Dispute Resolution (ADR) as well as certain judicial attempts of settling disputes may not always be easily determined, on the other hand, it can be stated that the ADR form of mediation is beyond its early stages and clearly shows its own procedural relevance. Procesně právní aspekty mediace v právu ES Eva Rivera, 2011 1 Abstrakt Disertační práce se zabývá problematikou procesně právních aspektů mediace a vychází z předpokladu, že se na mediační řízení nedá pohlížet odloučeně od procesních souvislostí, jestliže účinnost mediace nemá být ohrožena. Předmětem zkoumání je, jak dalece tento přístup nalezne potvrzení v právu Evropské unie. Mediaci je nutno pojmout mimo její vlastnosti komunikační techniky zejména jako řízení k řešení sporu. Jako taková se stává v Evropě stále důležitějším nástrojem pro řešení zejména občanských a obchodních sporů. V této souvislosti je relevantní její úloha ohledně dalších druhů řízení k řešení sporů resp. její prolínání s nimi. Přitom mohou být na jedné straně vymezení a přechod mezi mediací a dalšími formami tzv. Alternative Dispute Resolution (ADR) a dokonce i vůči soudním pokusům o smírné urovnání právního sporu zčásti plynulé. Die vorliegende Arbeit wurde einem bis dahin unerforschten Thema gewidmet, nämlich dem Komponisten Bohuslav Martinů und seiner Rolle im Musikleben des deutschsprachigen Raumes in den Jahren 1923-1939. Bohuslav Martinů, der seit 1923 in Paris lebte, richtete sein hauptsächliches Interesse dem Pariser Musikgeschehen und blieb mit dem Musikleben der ersten Tschechoslowakischen Republik in Verbindung. Dennoch wandte sich seine Aufmerksamkeit auch bald dem jungen Musikleben des deutschsprachigen Raums zu. Das Thema, das vom Interesse am Schaffen von Bohuslav Martinů geleitet ist, der zu Beginn der untersuchten Zeitspanne noch unbekannt war, jedoch rasch zu einem wichtigen Vertreter der Komponistengeneration der Zwischenkriegszeit avancierte, steht in mehreren Wechselwirkungen. Ausgehend von Recherchen zeitgenössischer Dokumente - Korrespondenz, Martinůs Notizen und Publizistik - wurden Studien zum Musikleben, zur Biographik und Rezeption durchgeführt. Jazykový management ve velkých nadnárodních podnicích německého původu v České republice

Given the international character of their staff and economic operations in general, multinational companies of German origin in the Czech Republic work in at least three languages: Czech, English and German. This thesis is based on ethnographic data from companies of this type, gathered using qualitative methods, primarily interviews and participant observation. Applying Language Management Theory (Neustupný, Jernudd, Nekvapil) the language situation of two particular companies is explored. With respect to the macro-social level (organized management) the companies conduct multilingualism management, in which the object of their language policy is institutional multilingualism, or the establishment of the position of certain languages and the guidelines for their use. On the micro-social level, the individual staff members conduct language management by applying certain communicative strategies. This study describes the emic perspective of the employees, who in their discourse on multilingualism construct identities, both their own individual identities and those of the company. Particular attention is devoted to the translators and interpreters, whose position is a specific one in respect of the language management and due to the national and professional identities in the companies. Nadnárodní podniky německého původu v České republice pracují minimálně ve tří jazycích (česky, anglicky a německy) a to z důvodů mezinárodní povahy pracovního kolektivu a hospodářské činnosti. Tato práce vychází z etnografických dat několika podniků tohoto typu, získaných díky kvalitativním metodám (především interview a zúčastněné pozorování). K metodologickému rámci patří konverzační analýza a analýza diskurzu. Aplikací teorie jazykového managementu (Neustupný, Jernudd, Nekvapil) je empiricky zkoumána jazyková situace dvou firem. Vzhledem k makrosociální rovině (organizovaný management) vykonávají firmy management vícejazyčnosti: předmětem jazykové politiky je tedy institucionální vícejazyčnost anebo zřízení pozice určitých jazyků a zásad pro jejich použití. Na mikrosociální rovině vykonávají jednotliví pracovníci jazykový management využitím určitých komunikačních strategií. Tato studie popisuje emickou perspektivu zaměstnanců, kteří diskurzem o mnohojazyčnosti konstruují identitu firmy a zároveň vlastní identitu. Zvláštní pozornost je věnována překladatelům a tlumočníkům, kteří mají vzhledem k jazykovému managementu a k národním a odborným identitám ve firmách specifickou roli.

Closer to the body. The urban female body and its perception in the Sokol and gymnastics movement in Prague and Dresden in the period prior to the First World War. The creation of modern cities and new urban forms brought with it new aspects of the perception of the female body. City boulevards offered women, on the one hand, greater freedom of movement and anonymity, and on the other, modified the discourse on discipline so that the moral integrity of women out on their own in the city was subject to constant scrutiny by passers-by; frequently, mere trivialities could bring a woman's image into question in the eyes of those around her. The image of women thus became strongly sexualised, wavering from that of the prostitute to that of girls on advertising boards. Photography, which developed into a mass medium in the second half of the 19th century, brought with it, too, new aspects in the perception of the female body. Photographic images, including portraits, represent an interesting avenue for discussion of the perception of the female body in historical research. Photographs allow the researcher to determine the qualities ascribed to the female body in the contemporary social discourse and how these were conveyed to viewers. Ženské tělo ve velkoměstě a jeho vnímání v sokolském a turnerském hnutí před první světovou válkou na příkladu Prahy a Drážďan. Vznikem moderních velkoměst vznikli nové prostory, které zásadně ovlivnily vnímání ženského těla v prostoru. Široké bulváry propůjčovaly na jednu stranu ženám pocit neomezeného pohybu a na druhou stranu je vystavily pohledům ostatních chodců, kteří pohledem zjišťovali jejich možnou sexuální přístupnost. Moderní města se staly místem neomezené vizuality, která se nejlépe promítla v podobě prostitutky a dívky z reklamního plakátu. Na změně ve vnímání těla se podílela i fotografie, která zavedla nový estetický diskurs vnímání sebe sama. Především portrétní fotografie se podílely na jeho utváření. Jak dokazuje analýza konkretních fotografií z prostředí pražského Amerického klubu dam, vypovídá medium fotografie o vnímání ženského těla více, než se na první pohled může zdát. Zásadní změny prodělalo i vnímání ženského těla v prostředí turnerské a sokolské tělovýchovy, kde se obraz ženy tvořil v interakci nacionálního, lékařského, hygienického a estetického diskursu, jak dokazují i zkoumané fotografie.

Dichotomy of fair and dark as representation of the discourses of power in the works of Libuše Moníková. "For black chickens!" The focus of this work, the figure of fair and dark (Hell- Dunkel-Figur), stands in the novels of Libuše Moníková as a representative example of the use of dichotomies as a repres- entation principle in the fictional literature. The figure is also seen as the means of critical fictional response to Mod- ernism. The figure of fair and dark which occurs in Pavane für eine verstorbene Infantin, in Treibeis, Der Taumel and Die Fassade is derived from the search for female identity in the context of two major areas - the control of the individual body and the body politic through the biopolitics and the sub- versive undermining of social constraint mechanisms. The study uses the "figurative method" (Auerbach) to describe the nature and functions of the fair and dark dichotomy and interprets the figure in relation to the female protagonists in two steps: The performance of the identity determination, with the consequence that biopolitical stereotypes and constraints as- signed by society are discarded in favor of identity as an artist/writer (Pavane für eine verstorbene Infantin, Treibeis), and as the personification of art in the form of Muses occupying the place of the mother... Dichotomie světla a temnoty jako princip reprezentace diskurzů moci v díle Libuše Moníkové. "Za černá kuřata!" Těžištěm této práce je figura světlého a tmavého (Hell-Dunkel- Figur) v německy psaných románech Libuše Moníkové. Tato figura (E. Auerbach) je příkladem pro dichotomii jako princip repre- zentace v próze a je prostředkem kritického literárního vy- rovnání se s modernou. Figura světlého a tmavého, jak se ob- jevuje v románech Pavane für eine verstorbene Infantin, Trei- beis, Der Taumel a Die Fassade nabývá význam v souvislosti s hledáním identity gender. Zviditelňuje správu individuálního těla a těla společnosti pomocí biopolitiky a vymknutí se ste- reotypním mechanismům společnosti (M. Foucault). Studie popisuje povahu a funkce dichotomie světlého a temného pomocí "figurativní metody" a interpretuje figuru ve vztahu k ženským postavám jako performanci určení jejich identity s tím důsledkem, že hrdinka zavrhne roli určenou jí společnos- tí ve prospěch identity umělkyně/spisovatelky (Pavane für eine verstorbene Infantin, Treibeis), a jako personifikaci umění v podobě Múz, které obsadí místo matky a manželky (Taumel), ale zároveň napomáhají překonání toposu neslučitelnosti umění se životem.
