Ideal Law School Graduate in the 21st century Abstract The thesis deals with the topic of the profile of a legal professional in the 21st century in connection with the recent technological advances in the legal services sector. The main goal of the thesis is to find out whether these technological advances in legal services delivery are sufficiently reflected in legal education, primarily in the Czech Republic. To fulfill this goal, the thesis uses mainly the methods of research, abstraction and document analysis, particularly in regard to scientific articles and other literature on the topic of legal technologies and their influence on the practice of law and the legal sector. The thesis first offers a brief overview of the professional values and skills typically associated with legal professionals, this overview is primarily based on the Anglo-American tradition and the McCrate Report. In the next part, the thesis describes some proactive characteristics of law - the author uses the term proactive to refer to the changes in law and its practice driven by the use of new technologies. The examples offered are primarily based on foreign sources. In the following part, the thesis deals with some reactions to these technological trends in legal education. Ideální absolvent právnické fakulty v 21. století Abstrakt Práce se zabývá tématem profilu právního profesionála ve 21. století ve spojení s technologickým pokrokem v oblasti právních služeb. Hlavním cílem práce je zjistit, zda je tento technologický pokrok na poli poskytování právních služeb dostatečně reflektován v právním vzdělávání, a to především v České republice. K plnění cíle využívá práce především metodu rešerše, abstrakce a metodu analýzy dokumentů, zejména odborných článků a další literatury k tématu právních technologií a jejich vlivu na právní obor. Práce nejprve poskytuje stručný přehled hodnotových a dovednostních východisek, jež jsou tradičně s právními profesionály spojena, přičemž vychází primárně ze zahraničních zdrojů a anglo-americké tradice, zejména tzv. McCrate Report. V další části práce popisuje některé tzv. proaktivní stránky práva - tento termín autor používá k popisu vlivu technologií na právní praxi. Příklady tohoto vlivu vycházejí primárně ze zahraniční literatury. V další části se práce zabývá reakcemi na tyto technologické trendy v právu, a to v oblasti právního vzdělávání. Intra-Party Democracy and Experience Gained During the First Czechoslovak Republic on the Example of the Agrarian Party Abstract and keywords The author investigates the topic of intra-party democracy during the First Czechoslovak Republic. He focuses primarily on the Agrarian Party. To be specific, he examines internal structure of the Agrarian Party and its compliance with the principles of intra-party democracy. He also carries out an analysis of legal environment of the First Republic with respect to the regulation of political parties and evaluates its potential impacts on intra-party democracy of political parties of the time. In Part One of the thesis, the author describes the internal situation in the Agrarian Party. He explores all the areas of the party's activities, namely in the order they are addressed in the organisational rules. The author takes a closer look at the greatest leaders of the party, intra-party disputes or political situation of the party in Slovakia and Carpathian Ruthenia. Vnitrostranická demokracie a zkušenosti z první republiky na příkladu agrární strany Abstrakt a klíčová slova Autor se v práci zabývá tématem vnitrostranické demokracie za první republiky. Svou pozornost věnuje především prvorepublikové agrární straně. Konkrétně zkoumá, jakým způsobem byla agrární strana vnitřně uspořádána a zda v jejím rámci byly dodržovány zásady vnitrostranické demokracie. Kromě toho autor analyzuje právní prostředí první republiky v oblasti regulace politických stran a hodnotí jeho možné dopady na vnitrostranickou demokracii tehdejších politických stran. V první části práce autor popisuje vnitřní poměry agrární strany. Autor se zabývá všemi oblastmi činnosti této strany a při jejím zkoumání postupuje podle systematiky jejího organizačního řádu. Blíže se věnuje významným osobnostem strany, vnitrostranickým rozporům nebo politické situaci strany na Slovensku a Podkarpatské Rusi. The political context of the selection of the judges of the Constitutional Court of the Czech Republic Abstract The thesis deals with the political context of the selection of judges of the Constitutional Court of the Czech Republic. The research question is whether the Senate's rejection of the President's nominees is more a manifestation of political power or a corrective to the high moral and professional quality of the Constitutional Court judges. Along with this, the thesis examines whether it would be appropriate to change the current legal regulation of the selection of constitutional judges. The first part of the thesis initially summarises the previous academic reflections on the topic, which mostly pointed out the inappropriateness of the possibility of reappointing constitutional judges, together with the linking of their terms of office to the president's, and the somewhat haphazard approach of senators to the assessment of candidates. Furthermore, this part of the thesis contains a definition of the research question consisting in a narrow conception of politics in the sense of policy. Politický kontext výběru soudců Ústavního soudu České republiky Abstrakt Diplomová práce se zabývá politickým kontextem výběru soudců Ústavního soudu České republiky. Výzkumnou otázkou je, zda odmítnutí prezidentových kandidátů Senátem je spíše projevem politické moci, nebo korektivem vysoké morální i odborné kvality ústavních soudců. Spolu s tím diplomová práce zkoumá, zda by bylo vhodné změnit stávající právní úpravu výběru ústavních soudců. První část práce nejprve shrnuje dosavadní odborné reflexe tématu, jež většinou upozorňovaly na nevhodnost možnosti opakovaného jmenování ústavních soudců, spolu s navázáním jejich funkčních období na prezidentovo, a na poněkud nahodilý přístup senátorů k posuzování kandidátů. Dále tato část práce obsahuje vymezení výzkumné otázky spočívající v úzkém pojetí politiky ve smyslu policy. Title: Neuromuscular control of motor units in strength and coordination dependent tasks for lower limbs. Objective: To compare muscle activity on the level of motor units through decomposition of surface electromyography signal from vastus medialis during given strength and coordination oriented movement tasks and to describe eventual differences in the parameters of tracked motor units in regards to given movement tasks. To assess the quality of chosen method for describing the muscle activity control on the level of motor units for further possible applications in the research and clinical environment. To summarize relevant knowledge acquired through the decomposition method of surface electromyography signal regarding the control of movement, motor unit activation and other relevant informations for clinical environment. Method: Theoretical part of the work presents the decomposition method, the process of its evolution and its constituent parts in the context of electromyographic evaluation of muscles along with selected chapters of neuromuscular kinesiology on the level of motor units. The experimental portion of presented thesis was carried out on 12 probands in the age of 23,2 (+- 5,3) years, who were instructed to perform the selected movement tasks of single leg squat in two different... Název: Řízení svalové aktivace u silových a koordinačních činností dolních končetin. Cíle práce: Využitím dekompozice signálu z povrchové elektromyografie porovnat svalovou aktivitu na úrovni motorických jednotek vasti medialis čtyřhlavého stehenního svalu při vybrané silové a koordinační pohybové činnosti a popsat případné rozdíly v parametrech nabraných motorických jednotek v kontextu dané pohybové činnosti. Zhodnotit kvalitu vybrané metody pro hodnocení řízení svalové činnosti na úrovni motorické jednotky pro možná další využití ve výzkumné a klinické praxi. Shrnout dosavadní poznatky získané skrz dekompozici EMG signálu ohledně řízení pohybu, aktivace motorických jednotek a dalších relevantních informací pro klinickou praxi. This dissertation thesis deals with individualization in music education in a heterogeneous class- room at the first level of primary school. The theoretical part focuses on the turnaround in edu- cation that occurred with the advent of reform pedagogy, bringing about efforts to change teaching,differentiation of studentsand curriculum,individualization of learning, and specialed- ucation projects. The text organizes the findings of general pedagogy, which are followed by the principles and suggestions of the disciplinary didactics concerning the teaching of music educa- tion. At the same time, the specifics that distinguish music education from other subjects and influence the feasibility of individualization or the choice of appropriate methods are presented. The chronological arrangement of the findings from the general and disciplinary didactics is completed with a description of the situation in the present school. This is characterised by the 'diverse classroom', in which pupils with different talents, from different family back- grounds, with different attitudes to education, music and culture, or speaking different mother tongues learn together. Tato disertační práce se zabývá individualizací při výuce hudební výchovy v heterogenní třídě na prvním stupni základní školy. Teoretická část je zaměřena na obrat ve vzdělávání, který nastal s příchodem reformní pedagogiky a přinesl snahy o změnu výuky, diferenciaci žáků a učiva, individualizaci učení i mimořádné vzdělávací projekty. V textu jsou utříděny poznatky z obecné pedagogiky, na které navazují principy, zásady a podněty oborové di- daktiky týkající se výuky hudební výchovy. Zároveň jsou uvedena specifika, která hudební výchovu odlišují od ostatních předmětů a mají vliv na proveditelnost individualizace nebo volbu vhodných metod. Chronologické uspořádání poznatků z obecné i oborové didaktiky je završeno popisem si- tuace v současné škole. The thesis deals with the position of the Speaker of the House of Commons of the United Kingdom of Great Britain and Northern Ireland. It analyses the position of the Speakers of the parliaments in six selected cases, which are the devolved parliaments and the parliaments of Crown dependencies. The thesis aims to determine whether the position of the Speaker of the parliament in the devolved parliaments of Scotland, Wales, and Northern Ireland, and the parliaments of Crown dependencies, namely the Isle of Man, Jersey, and Guernsey, is derived from the British model. The first part of the thesis introduces the institution of the Speaker of the House of Commons of the United Kingdom and its significant position within the Westminster Parliament. The thesis then examines the position of the Speakers of the devolved parliaments of Scotland, Wales, and Northern Ireland, which were established as part of the devolution process in 1998. It then analyses the position of the Speakers in the parliaments of the Isle of Man, Jersey, and Guernsey, which have been Crown dependencies of the United Kingdom since 1801. Diplomová práce se zabývá postavením předsedy Dolní sněmovny Parlamentu Spojeného království Velké Británie a Severního Irska a analýzou postavení předsedů parlamentů v šesti vybraných případech, kterými jsou devoluční parlamenty a parlamenty korunních dependencí. Záměrem práce je zjistit, zda se postavení předsedy parlamentu v devolučních parlamentech Skotska, Walesu, Severního Irska a parlamentech korunních dependencí, kterými jsou Ostrov Man, Jersey a Guernsey, odvíjí od britského modelu. První část práce představuje institut předsedy Dolní sněmovny Parlamentu Spojeného království a jeho signifikantní postavení v rámci Westminsterského parlamentu. Následně práce zkoumá postavení předsedů parlamentů Skotska, Walesu a Severního Irska, jejichž funkce byla ustanovena v rámci devolučního procesu v roce 1998 a poté jsou analyzována postavení předsedů v parlamentech Ostrova Man, Jersey a Guernsey. Poslední část práce provádí komparaci vybraných případů s případem Spojeného království a jsou identifikovány shodné a odlišné rysy v postavení předsedů parlamentů. Práce by měla zodpovědět otázku, zda je pozice předsedy parlamentu ve vybraných případech ustanovena podobným způsobem jako je tomu v případě britského speakera.

Empty Shells. Three Tales on the Relativization of the Axiological Core of Democracy - Abstract JUDr. Bc. Filip Horák The purpose of this thesis is to discuss the problem of gradual softening of the democratic political system's axiological core. Firstly, the thesis illustrates the problem via three tales narrated by Carl Schmitt, Hannah Arendt and Leo Strauss, who in a very similar manner critically analyzed the "axiological leap" leading to the disintegration of fundamental values and principles of democracy. Secondly, the thesis offers a new methodological approach combining empirical functional analysis of the individual values constituting democracy's axiological core (i.e. equality, liberty, justice and dignity) with a teleological approach focusing on the original purposes and functions of these values. Using functional analysis, the thesis examines possible interpretations and functions of the aforementioned values and shows that all of them evince a high degree of vagueness and ambiguity, which makes them so-called "empty shells" that can be filled with almost any content, meaning or function. This is also the main cause of the disintegration of the democracy's axiological core. Filip Horák Cílem této práce je pojednat o problému postupného rozmělňování axiologického jádra demokratického politického systému. Práce nejprve ilustruje tento problém prostřednictvím tří příběhů z pera Carla Schmitta, Hannah Arendt a Leo Strausse, kteří velmi podobným způsobem kriticky analyzovali "axiologický skok", vedoucí k rozvolňování hodnotových a principiálních základů demokracie. Následně práce nabízí nový metodologický přístup propojující empirickou funkcionální analýzu jednotlivých hodnot tvořících axiologické jádro demokracie (tj. rovnosti, svobody, spravedlnosti a důstojnosti) s teleologickým přístupem zaměřujícím se na původní účely a funkce těchto hodnot. Prostřednictvím funkcionální analýzy práce zkoumá možné významy a funkce uvedených hodnot, a ukazuje, že všechny vykazují vysoký stupeň vágnosti a mnohoznačnosti, což z nich činí tzv. This thesis focuses on submunicipal democracy in the Czech Republic and in the European context. Submunicipal democracy and its units form the lowest level of political systems in small and large municipalities. It is a topic that has so far been studied only at the level of individual states and in a very limited way, despite the fact that units are found in many European countries. The paper provides an overview of the types of submunicipal units in Europe with their basic characteristics, and outlines a possible typology according to which submunicipal units in Europe could be categorised. The next part of the thesis deals with the situation in the Czech Republic. The units that represent submunicipal democracy in the Czech Republic are called submunicipal or local councils. These are established by municipal councils in local parts of towns and municipalities. The thesis establishes how submunicipal councils in the Czech Republic are established and how they are set in a historical context. Due to the previous unexplored nature of the topic, a multi-case study of submunicipal councils was carried out to find out how Czech municipalities approach the establishment of submunicipal councils and what position submunicipal councils have in the political system of towns and municipalities. Součástí práce je přehled typů subkomunálních jednotek v Evropě s jejich základními charakteristikami a dle nich je nastíněna možná typologie, dle které by se subkomunální jednotky v Evropě mohly kategorizovat. Další část práce se věnuje situaci v České republice. Jednotky, které představují submunicipální demokracii v České republice se nazývají osadní nebo místní výbory. Ty jsou zřizovány zastupitelstvy municipalit v místních částech měst a obcí. V práci je zjištěno, jak jsou osadní výbory v České republice legislativně zakotveny, a jsou zasazeny do historického kontextu. Z důvodu dosavadní neprobádanosti tématu byla provedena vícepřípadová studie osadních výborů, jejímž cílem bylo zjistit, jak české municipality k zakládaní osadních výborů přistupují, a jaké postavení mají osadní výbory v politickém systému měst a obcí. Bylo rovněž prozkoumáno, jaké vztahy panují mezi zastupitelstvy měst a obcí, osadními výbory a občany místních částí....

178 Common defence policy in the context of EU law Abstract: This thesis deals with the common defence policy in the context of EU law. The common defence policy is an undefined area of the EU's common defence and security policy. The first part of the work is devoted to the necessary theory of security policy, the theoretical concept of grand strategy, deterrence strategy and a brief history of the security integration of Europe, up to the establishment of the European Union and the increasingly extensive legal regulation of the area of common security and defence policy. Special emphasis is placed on the presentation of less well-known concepts in the Czech Republic, such as the theory of grand strategy, the theoretical approach to the formation of an ends-ways-means strategy and peace research. Peace is seen in the work as an ideal state, which itself, however, needs wider theoretical research. An understanding of peace theory is important for understanding the steps the European Union must take towards potential allies and systemic adversaries in order to ensure the security of its sovereignty, democracy and the lives, health and property of its citizens and residents. Negative peace is maintained through hard power and a strategy... 177 Společná obranná politika v kontextu práva EU Abstrakt: Tato diplomová práce se zabývá společnou obrannou politikou v kontextu práva EU. Společná obranná politika je zatím nevytyčená oblast společné obranné a bezpečnostní politiky EU. První část práce je věnována nutné teorii bezpečnostní politiky, teoretickému konceptu grand strategy, strategii odstrašování a stručným dějinám bezpečnostní integrace Evropy, až po vznik Evropské unie, a čím dál extenzivnější právní úpravě oblasti společné bezpečnostní a obranné politiky. Zvláštní důraz je kladen na představení v České republice méně známých konceptů, jako je teorie grand strategy, teoretický přístup k formování strategie ends-ways-means, a výzkumu míru. Mír je v práci nazírán jako ideální stav, který ale sám o sobě potřebuje širší teoretický výzkum. Pochopení teorie míru je důležité pro chápání kroků, které Evropská unie musí podnikat směrem k potenciálním spojencům a systémovým protivníkům, aby zabezpečila svou suverenitu, demokracii a život, zdraví a majetek svých občanů a obyvatel.
