Legal Liability of a Social Services Employee

The author explains the term of legal rule and legal consciousness, he determines the preconditions leading to the legal liability origination. Apart from general liability, he also mentions special kinds of liability for damage. He also pays attention to the new legal regulation of the protection of personal data. Autor vysvětluje pojem právní normy a právní vědomí, stanoví předpoklady vedoucí ke vzniku právní odpovědnosti. Uvádí kromě obecné odpovědnosti i zvláštní druhy odpovědnosti za škodu. Pozornost věnuje nové právní úpravě ochrany osobních údajů.

Reflections on the system of foster parents training in the Czech Republic

The authors devote their article to foster care as a part of the system of endangered children care. To ensure professional training of foster parents it is necessary to build up a new system which would help create necessary preconditions for quality performance of foster care. Autoři se ve své stati zabývají pěstounskou péčí jako součástí systému péče o ohrožené děti. Pro zajištění odborné přípravy pěstounů je potřeba vybudovat nový systém profesní přípravy, který by vytvořil základní předpoklady pro kvalitní výkon pěstounské péče.

Consumer credits - Revision of the Legal Regulation

The article concentrates on the news brought by the currently adopted consumer credit directive. From the consumer´s point of view, the fundamental change has proved to be creditor´s duty of assistance, duty to inform, duty to assess creditworthiness and consumer´s right to withdraw from a contract. Článek se zaměřuje na novinky, které přináší nově přijatá směrnice o spotřebitelských úvěrech. Jako zásadní změna z pohledu spotřebitele se jeví asistenční povinnost věřitele, rozsáhlá informační povinnost, povinnost posuzovat úvěruschopnost a oprávnění spotřebitele odstoupit od smlouvy.

Public interest in commercial law - contradictio in adiecto? Or: Ouroboros on the march

The text concentrates on the vague concepts in private law, if their content is determined ex post by judicial (public) power and if they can interfere with legitimate expectations of private individuals. The premise is that the content of public interest is unknown and yet it may result e.g. in contract invalidity. The author takes into account also the risk of comparison, or path dependence, in civil law recodification. Text je zaměřen na využití vágních pojmů v soukromém právu, pokud jejich obsah určuje ex post soudní (veřejná) moc a pokud mohou zasáhnout do legitimních očekávání soukromých osob. Vychází se z teze, že obsah veřejného zájmu je neznámý a přesto může vést např. k neplatnosti smlouvy. Součástí úvahy je zohlednění rizika komparace, resp. jevu path dependence při rekodifikaci občanského práva.
